The owner of the Mega Gym, Dan Marino, is exposed to civil or criminal prosecution, according to lawyer François-David Bernier.

Mr. Marino could indeed face a lawsuit for damages or a class action that would bring together all the infected people, who could claim compensation after catching COVID-19 between the walls of the gym.
Worse yet, he could face a charge of criminal negligence causing death, up to and including life imprisonment. “We must be careful, since it is new as a law, everything related to the Covid”, warns Me Bernier.
In all cases, it would be necessary to prove that the complainant did indeed contract the virus at the Mega Gym and that his owner was negligent in putting the lives of people in danger, by not respecting health measures.
“You have to prove that he did not follow the rules, not the details, but it must be important,” said the lawyer.
Mr. Marino did not answer our calls on Wednesday.
